1. Acceptance of Terms

By accessing or using any HYPEX website, forum, or software (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services.

These Terms constitute a legally binding agreement between you ("User", "you") and HYPEX ("we", "us", "our").

2. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use our Services. By using our Services, you represent and warrant that you meet this requirement.

3. License & Usage

Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to use our software for personal use only. This license is subject to the following conditions:

• You may not redistribute, resell, sublicense, or share your license with any third party.
• You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of our software.
• You may not modify, adapt, or create derivative works based on our software.
• You may not use our software for any commercial purpose without prior written consent.
• Each license is bound to a single user and may not be transferred.

4. Digital Product Delivery

All products are delivered digitally through our customer panel. Upon purchase, you will receive immediate access to download and use the software. By completing a purchase, you acknowledge that delivery of digital content begins immediately.

In accordance with Article 16(m) of the EU Consumer Rights Directive (2011/83/EU), you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the digital content has been delivered and the license has been redeemed.

5. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate and complete registration information.
• Not share your account or license key with others.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

6. Prohibited Conduct

You agree not to:

• Use our Services in violation of any applicable law or regulation.
• Attempt to circumvent any security measures or access controls.
• Interfere with or disrupt the integrity of our Services or servers.
• Use automated systems (bots, scrapers) to access our Services without permission.
• Harass, abuse, or threaten other users on our forum or Discord.
• Post or share malicious content, spam, or unauthorized advertising.

7. Intellectual Property

All content, software, code, designs, trademarks, and other intellectual property associated with HYPEX are owned by us and protected by applicable intellectual property laws, including those of the European Union. You may not use our intellectual property without prior written consent.

8. Termination

We reserve the right to suspend or terminate your account and access to our Services at any time, with or without cause, including but not limited to:

• Violation of these Terms.
• Sharing or redistributing your license.
• Engaging in prohibited conduct.
• Fraudulent or suspicious activity.

Upon termination, your license is immediately revoked and you must cease all use of our software.

9. Limitation of Liability

To the maximum extent permitted by applicable law, including EU consumer protection regulations:

• Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
• Our total liability shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable EU or national law.

10. Updates & Availability

We strive to keep our software updated and functional. However, we do not guarantee:

• Uninterrupted availability of our Services.
• That our software will be compatible with all systems or game updates at all times.
• Specific update timelines or schedules.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts.

For consumers within the EU, this does not affect your statutory rights under mandatory consumer protection laws of your country of residence. You may also use the EU Online Dispute Resolution platform.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our Services after changes constitutes acceptance of the updated Terms.
